While on vacation Bruce may be unable to receive email and send email messages because of a possible lack of easy access to computer hook ups at the above resorts. 1. Please NOTE, Our policy requires the renter of the rental party must be able to prove that they are at least 25 years old upon check in to permit use of the unit by the renter. A credit card imprint will be required upon check by the resort in to cover any possible damages
to the unit or resort.
The person who’s name that is to be put on the rental lease must be willing to send proof of their age being 25 years or older by the use of some type of official picture ID in order to rent from us. The person who’s name is on the rental agreement must be present in order for their group to be allowed to be checked in without advance emailed permission from us the landlord to the resort. Thank you in advance for your cooperation if needed in meeting requirement on verifying age requirements.

The Unit being rented is condo unit number 6F. in the Topsider resort located at 75500 Overseas Highway, Islamorada, FL 33036.

Our resort is a Private Gulf Of Mexico Water Front Keys resort and is not a Mega size cookie cutter impersonal resort, but a resort that some say feels like one large family that has ample amenities to help provide lots fun for a memorable vacation. Our resort has only 20 individual condo Villa units.
Our resort is one of the few Keys resorts that has its own sandy beach for swimming. You will have access to our resorts boat slips to dock your boat and the resorts boat ramp. You will be able to call ahead to reserve your asap after paying for the rental of our condo unit. The fishing near the resort is said to be very good. Our resort has paddle boats and bicycles for your use. One you get done fishing, using the paddle boats, tennis court, or the outside pool you can relax in our resorts Jacuzzi.
Within 5 minutes drive of our resort you can rent boats, wave runners or you can water ski, sail, snorkel, swim, etc. With in less than a one half hour drive you can go to the Theater Of The Sea were you could swim with the dolphins and other sea creatures. There are many things to see and do at our resort. It is possible from our resort to see both the Gulf Of Mexico and the Atlantic Ocean.
These condo units have 2 bedrooms and 6 bathroom, Maximum occupancy is 6 people according to the resort rules. This unit has air-conditioning, a full kitchen, with microwave. There are barbecue grills for your use. These are one story units set on about a 8 foot pedestal with no other units above or below these units. The effect is that you walk up steps so in essence they are single story units at a second floor height, All units are a free standing 8 sided units and NONE are side by side units that have walls that attach to another’s condo’s units walls .
Our unit is about 900 square feet when not counting the wooded deck. You can go to http://www.topsiderresort.com to check out our units and resorts design layout, etc.
Standard in all units. Toilet paper, garbage bags, laundry baskets, towels, glassware, paper towels, broom and dust pan, mop and bucket, pots and pans, clock radio, toaster/toaster oven, hand and dish washing soap, vacuum cleaner, bed linen, cooking utensils, coffee maker, blender, silver ware, iron and ironing board.
4. Length of rental week number 4, year of 2009 is for 7 nights. Your rental begins on check-in at 3:00 PM Saturday January 24, 2009 and check out is on or before Saturday January 31, 2008 at 10:00 AM. If you do not plan to check in on your assigned check in date, but plan to check in on a later date we suggest that you contact the resort and advise them of that fact one or two days before your reservation check in date as stated on your confirmed reservation. By calling the resort a head of time they will know that you still plan to use it and not mistakenly assign your unit to someone else.
IMPORTANT, seeing that there are only 20 condo units in the resort, the resort does not have 24 hour a day open office. So call a head if you are not going to arrive during regular office hours so you can make arrangements to pick up your units keys.
5. Rent for the unit as listed for the date above is $1,299 in US Dollars . This is in comparison to the resorts price of $1,338. when you include their sales tax if they happen to have a unit available for this week. PLEASE NOTE, NO PERSONAL CHECKS WILL BE ACCEPTED if with in 30 days of the check date, DO NOT SEND CASH. If with in 30 days of reservation check in date please send BANK CASHIERS CHECK, MONEY ORDER, ETC. Payment required to secure unit is 100% of rental price as show for our ownership weeklisted above.
Also required is a additional $200. refundable security deposit per unit that is to be paid at the same time as the rental deposit is paid. The refundable $200 security deposit refund is to be sent by snail mail or email to the renter with in 5 business days or less after the above check out date has passed if no damage fees or any other unpaid fees are owed by the renters to the resort. Please make check payable to Bruce F. Czajkowski in the amount of $1,499 US Dollars.
There is a no refund policy once the timeshare is rented. The only type of refund that would be allowed is if the this unit is if it is uninhabitable as stated in part numbered section 7 of this rental lease agreement, and no other similar units are available for the same week at this resort. The parties have signed their names below to evidence their agreement to the terms and conditions of this rental agreement,
6. The tenant agrees to rent the Unit from the landlord, and the landlord agrees to lease the Unit to the tenant.
7. The term of the lease is only for the exact period designated in paragraph 4. The tenant may use the Unit during the term without interference subject to the terms of this lease. If the Unit is not habitable on the day that the term starts by reason of flood, fire, storm, or for any other reason, the landlord shall refund the rent forthwith and will thereafter have no further liability to tenant.

You may also want to contact local travel agents and check out the cost of the of a level of a Travel Insurance package that you feel comfortable to protect your self against unforeseen circumstances that may affect or end your vacation plans.

8. The tenant agrees to pay the rent as set forth in paragraph 5 at the times stated in that paragraph. If the rent is not received by landlord on or before the date specified, the landlord may declare the tenant in default by written notice sent by either certified mail, e-mail, or fax. If the default is not cured within 3 days after receipt of the notice, the landlord may rent the Unit to others.
9. The tenant may use the Unit only in accordance with the rules and regulations of the resort in which the Unit is located. No pets are allowed. If the tenant's or their guests violate the resort rules which results in resort kicking them out, there will be no refund of any portion of the rent for the unused time.
10. The landlord will pay maintenance fees and all utility charges for the Unit.
11. The tenant will pay for all the telephone calls made from the Unit, any housekeeping services for which there is an additional charge, and any extra charges (except utilities) imposed by the resort for services or for the use of its facilities.
12. The tenant agrees to maintain the Unit in the same condition as it is at the start of the lease term, except for ordinary wear and tear. The tenant will pay for all repairs, replacements, and damages caused by the act of neglect of the tenant, the tenant’s household members, or guests
13. Immediately upon receipt of the full rental payment, the landlord will notify the resort manager in writing that the tenant will be occupying the Unit during the stated term. At this time, a copy of the letter will be sent by landlord to tenant.
14. The landlord is not responsible for any inconveniences or interruption of services due to repairs, improvements, or for any other reasons beyond the landlord’s control.
15. The tenant may NOT sublease the unit or assign this lease without the landlord’s prior written consent.
16. All notices may be sent to the address, e-mail, or fax numbers set forth in the opening paragraphs of this lease.
17. Additional charges for services and activities may be charged additional fees by the resort to the tenant, including, but not limited to golf, ski hill, craft materials, etc.

Below is a list of the group of Holiday weeks that we presently have confirmed reservations for rent at our Florida Bay Resort in 2008 and 2009. Also listed is our 2 bedroomroom 2 bathroom Topsider I Resort in Islamorada that is also in the Florida Keys that has a check in date of January 24, 2009 and for February 14, 2009. The Tposider is a deeded fixed week number four and seven so the rental week dates can not be changed like our Florida Bay weeks dates can.
We do suggest you contacting us asap and hopefully at least 9 months ahead (if you have the freedom to make plans that far ahead) for the week you want if you want a Holiday or any other week reserved at our Florida Bay Club or our Topsider Resorts in the Florida Keys.
We think this would be good prudent planning on your part to try and avoid vacation time disappointment for your family because of a lack of unit inventory availability as our resort has a total of only 18 total condo units, and most of our resorts condos are being used for their owners own vacations and so those units are not available for rent.
On a average usually only one to three of our resorts condo’s units per week may available for rent. Some high demand Holiday weeks there may be only one our of weeks available for rent.

If you want us to cancel one of these high demand holiday weeks to book a special request for you then a prepaid $200 good faith refundable down payment must be made before we try to fulfill your special request and cancel a week we presently have reserved. We only do full week rentals, not any partial week or daily rentals.
The main reason for this policy is that we may have already reserved a different hard to reserve high demand week and would have to cancel that high demand week to try and accommodate your request.
We require a $200 refundable security deposit on all reservations. So if sending in a check ad $200 to the above totals. DO NOT add for sales tax on our rentals like you would if renting through the resort.
