Our resort's rental price for this unit as per our resort's website was as of September 28, 2007 with the resorts 11 1/2% Florida Sales tax the resorts rental price totals $1,672.50. You can $ave $273.50. on our Holiday week rental price total cost of only $1,399. by renting directly from us. This 3 bedroom Deeded floating week ownership is also for sale for only $4,599.

IMPORTANT PLEASE NOTE, in order to try to be fair to all interested potential interested renters the first prospective tenant to send us full payment, will secure the unit, and other later arriving checks will be returned. The EARLIEST POSTMARK check gets our unit if two checks arrive for the same reservation date.
We suggest that you reserve and confirm your rental request asap as our resort has a total of only 18 total condo units, and most of our resorts condos are being used for their owners own vacations and so those units are not available for rent.
On a average usually only one to three of our resorts condo’s units per week may available for rent. Some high demand Holiday weeks there may be only one of our resorts weeks available for rent on a first come first serve basis.
There are only 18 Villa style condo units at our resort and there are only five 3 bedroom condo units at our resort. There are very few 3 bedroom units in the entire Florida Keys north of Key west.. Our units are approximately 2,000 square foot (as per resorts website) condo in great location on the Gulf of Mexico and close to the Atlantic that also has its own private garage.
All of the units are floating weeks so we can book any week in a 2 or 3 bedroom depending on unit availability if requested far ahead enough before the check in date requested. The 2 bedroom, 3 bathrooms are a sleep 6 unit and the 3 bedroom 4 bathroom units are sleep 8 units. All units have 4 balconies.
Our resort is a Private Gulf Of Mexico Water Front Florida Keys resort and is not a Mega size cookie cutter impersonal resort, but a resort that some say feels like one large family that can provide for a memorable vacation.
You will have access to our resorts boat slips to dock your boat AT NO CHARGE to you during your stay. We will call ahead to reserve your slip asap after you have secured your rental with us.
Our resort is less than one mile away from the John Pennekanp State Park entrance were you can enjoy some of the best diving and snorkeling found anywhere on the only 'living reef' in the United States.
You will be able to fish from our resorts private wooden boardwalk or on our resorts piers using the resorts rods and reels. You will be able to see the Everglades in the distance from our resorts piers. . You may be able to catch shrimp with the resort supplied shrimp nets in the passé that borders our resorts north edge. You can enjoy the sunsets with the beverage of your choice on our large balconies.
Within 5 minutes drive of the resort you can rent boats, wave runners or you can water ski, sail, snorkel, swim, etc. With in less than a one half hour drive you can go to the Theater Of The Sea were you could swim with the dolphins and other sea creatures.

To avoid any possible confusion we are NOT selling our 3 bedroom 4 bath unit or our 2 bedroom 3 bedroom Gulf Front 'C' unit for $3,333. The price for either one of these 2 of our ownership units would be $4,599.
The ownership that we are selling for $3,333. is Our Floating Deeded Ownership which is a two bedroom three bathroom unit that can be reservered for any week of the year in any 'A' or 'B' two bedroom unit if reserved soon enought.
That 9 months or more lead time is especially important in regard to our Gulf Front “C” unit and for our 3 bedroom sleep 8 units. There are only 2 “C” units in the entire resort and only five 3 bedroom units in our resort which we have access to both types to reserve if contacted far enough a head of time.
On our 'C' units over one year lead time would be prudent and give you a better chance of obtaining the exact vacation week you want.
Please note that as per the resorts rules, absolutely no pets of any kind are allowed in any of our resort’s units. Violate this rule and you will have to leave and face up to a $250 or more sanitizing cleaning charge and in addition the loss of your security deposit.

1. Please NOTE, Our policy requires the renter of the rental party must be able to prove that they are at least 25 years old upon check in to permit use of the unit by the renter. A credit card imprint will be required upon check in to cover any possible damages to the unit or resort.
The person who’s name that is to be put on the rental lease must be willing to send proof of their age being 25 years or older by the use of some type of official picture ID in order to rent from us. The person who’s name is on the rental lease must be present in order for their group to be allowed to be checked in without advance emailed permission from us the landlord to the resort. Thank you in advance for your cooperation if requested on meeting requirement on verifying age.

3. Our unit being rented is unit number A9 . Our unit is located at “The Florida Bay Club” which is RCI resort number 5130. The resort address is Milemarker 103.5, PO Box 2250, Key Largo, Florida 33037. The resorts telephone number is 1-.305-451-0101. This unit from 2 of its 4 balconies has a view of the Adams Passe Way which is a water way that fairly large boats can use to go from the Atlantic to the Gulf. This unit does not have a Gulf of Mexico view.
Our units have 4 private balconies and their own private garage on the lowest of the three levels. Our units have 3 bedrooms and 4 BATHROOMS and 4 balconies. Our unit has its own unit washer and dryer.
Maximum sleeping occupancy is 8 people per unit according to the resort rules.
These units have air-conditioning, a full kitchen, with microwave oven. These are three story units with no other units above or below these units. Standard In All Units. Toilet paper, garbage bags, laundry baskets, towels, glassware, paper towels, broom and dust pan, mop and bucket, pots and pans, clock radio, toaster/toaster oven, hand and dish washing soap, vacuum cleaner, bed linen, cooking utensils, coffee maker, blender, silver ware.
Vacation condo unit A9 is the unit that we have reserved at our resort (it is approxately about 2,000 square feet as per the resorts website). Our unit is 3 bedroom sleep 8 townhouse condo that has 4 bathrooms.
We think our unit and our resort will help to make your vacation holiday something special. Our three story, four balcony vacation condo has its own private garage on its lowest level.

Our resort also offers exercise equipment, tennis, outdoor swimming pool, fishing, etc.
Our Florida Bay Club is a private gated condo community located on the gateway to the Florida Keys in Key Largo. The spacious living room and dining room give you plenty of space to relax and enjoy your stay. Our large kitchen with all the appliances will help you to enjoy your stay.
Florida Bay Club is close to Pennekamp State Park where you can enjoy some of the best swimming, diving and snorkeling around.
If fishing is your enjoyment, Florida Bay Club has its own 'Captain' for trips out on the back water or on the Atlantic Ocean. Bring your boat and tie up at our dock on the bay. Ocean access from the Club runs along our property.
Swim with the Dolphins at Dolphins Cove and the Dolphin Research Center. Key West is a short trip to the Southern Most Place in the U.S. Walk Duval Street and famous local residences of Ernest Hemingway and President Harry Truman. Visit Key West and enjoy the festivities at Sunset.
For you Divers the USS Spiegel Grove a 510 foot ship was recently sunk near Dixie Shoals just off Key Largo. Come join us for a stay you will always remember!
4. Length of rental week number 8 is for 7 nights. Your rental begins on check-in at 3:00 Saturday February 21, 2009 and check-out is on or before Saturday February 28 , 2009 at 10:00 AM If you do not plan to check in on your assigned check in date, but plan to check in on a later date we suggest that you contact the resort and advise them of that fact one or two days before your reservation check in date as stated on your confirmed reservation. By calling them a head of time they will know that you still plan to use it and not mistakenly assign your unit to someone else.
IMPORTANT PLEASE NOTE, in order to try to be fair to all interested potential interested renters the first prospective tenant to send the landlord a check with payment, will secure the unit, and other later arriving checks will be returned. There is a NO REFUND POLICY once the timeshare is rented. The only type of refund that would be allowed is if the this unit is if it is uninhabitable as stated in part numbered section 7 of this rental lease agreement, and no other similar units are available for the same week at this resort. The parties have signed their names below to evidence their agreement to the terms and conditions of this rental lease.
5A. Rent for this unit as listed for the date above is $1,399 (in US Dollars). PLEASE NOTE, NO PERSONAL CHECKS WILL BE ACCEPTED if with in 30 days of the check date, DO NOT SEND CASH. If with in 30 days of reservation check in date please send BANK CASHIERS CHECK, MONEY ORDER, ETC. Payment required to secure unit is 100% of rental price as show above for this confirmed reservation.
Also required is a additional $200. refundable security deposit per unit that is to be paid at the same time as the rental deposit is paid. The refundable $200 security deposit refund is to be sent by snail mail or email to the renter with in 5 business days or less after the above check out date has passed if no damage fees or any other unpaid fees are owed by the renters to the resort. Please make check payable to Bruce F. Czajkowski in the amount of $1,599 US Dollars.

5B. In most cases for special request for a non existing reservation check in date that we do not have a confirmed reservation for, there is NO CHARGE to have us check for availability for your special request that we do not have reserved at that time.
But a $200 good faith Pay Pal Good Faith down payment is required before we will CANCEL one of OUR confirmed reservations and try for a period of 2 business days after the Pay Pal good faith down payment is received to reserve your special request time period.
The main reason for this policy is that we may have already reserved a hard to reserve high demand reservation and may have to cancel that high demand reservation to try and accommodate your request.
The reason we have the rule as it is not fair to the owners to have the owners cancel a high demand and book a sprcial request week, so their efforts and time is not wasted by people who made that special request and then not rent.
Once the confirmed reservation is made the renter-tenet after being emailed is to send in the remaining balance due with in 24 hours.
6. The tenant agrees to rent the Unit from the landlord, and the landlord agrees to lease the Unit to the tenant.
7. The term of the lease is only for the exact period designated in paragraph 4. The tenant may use the Unit during the term without interference subject to the terms of this lease. If the Unit is not habitable on the day that the term starts by reason of flood, fire, storm, or for any other reason, the landlord shall refund the rent forthwith and will thereafter have no further liability to tenant.
Here are some links to renter's Travel Insurance that could help lessen any financial loss because of unforeseen circumstances of storms and other weather problems, travel problems like airline strikes or Airline Bankruptcies, health , etc problems or any other problems causing financial loss the landlord did not cause and is not responsible for.
You may also want to contact local travel agents and check out the cost of the of a level of a Travel Insurance package that you feel comfortable to protect your self against unforeseen circumstances that may affect or end your vacation plans.

8. The tenant agrees to pay the rent as set forth in paragraph 5 at the times stated in that paragraph. If the rent is not received by landlord on or before the date specified, the landlord may declare the tenant in default by written notice sent by either certified mail, e-mail, or fax. If the default is not cured within 3 days after receipt of the notice, the landlord may rent the Unit to others.
9. The tenant may use the Unit only in accordance with the rules and regulations of the resort in which the Unit is located. No pets are allowed. If the tenant's or their guests violate the resort rules which results in resort kicking them out, there will be no refund of any portion of the rent for the unused time.
10. The landlord will pay maintenance fees and all utility charges for the Unit.
11. The tenant will pay for all the telephone calls made from the Unit, any housekeeping services for which there is an additional charge, and any extra charges (except utilities) imposed by the resort for services or for the use of its facilities.
12. The tenant agrees to maintain the Unit in the same condition as it is at the start of the lease term, except for ordinary wear and tear. The tenant will pay for all repairs, replacements, and damages caused by the act of neglect of the tenant, the tenant’s household members, or guests
13. Immediately upon receipt of the full rental payment, the landlord will notify the resort manager in that the tenant will be occupying the Unit during the stated term. At this time, a “letter to the resort” will be sent by landlord to tenant to be presented upon check in.
14. The landlord is not responsible for any inconveniences or interruption of services due to repairs, improvements, or for any other reasons beyond the landlord’s control.
15. The tenant may not sublease the unit or assign this lease without the landlord’s prior written consent.
16. All notices may be sent to the address, e-mail numbers set forth in the opening paragraphs of this lease.
