Our resort is on its' own Private Caribbean Island. It is a Sleep 4 condo unit for rent from )from Saturday March 13, 2010 to Saturday March 20, 2010 (Week 11) for only $899. for the full week. Our rental price DOES include the resorts special assessment for 2010 of a $56 energy surcharge that must be prepaid before usage.

Important Please Note, that our resort IS NOT a Mandatory all inclusive resort were you are forced to pay a Mandatory $200 to $400 PER DAY for a family of 4 meal plan.
Those type of Mandatory all inclusive meal plans may not be of the quality and type of foods that you prefer to eat for a preset expense that you can do nothing about. Sorry, no daily or partial week rentals of our ownership unit-weeks are available from us.

Please Note, if our week 11 for 2010 is not rented as of or before February 17, 2010 then we may give our week to the resort to rent out for us at their higher rental prices.
Another option for us is that if we want to we can have our vacation ownership weeks rolled over into the year of 2011 at no cost to us to be available for our use in 2011 so our weeks will not go to waste if no one rents our unit for use in 2010.
Please note as of November 1, 2008 because of record high Electric costs the resorts HOA Board voted a $8 per night energy surcharge for resort owners and their guests, or $56 per week. We will prepay that energy surcharge. By comparison if you were a RCI exchanger you would pay an extra $95 per week for that energy surcharge.
Our rental price includes the resorts $56 energy surcharge charge fee to the owners TO BE PAID BY US on your behalf to the resort after your payment is made to us and there are NO TAXES for you to pay. Your winning bid price is the ONLY amount you have to pay if you follow the resorts check out rules and you or your guests not causing any type of damage.

Please Note that located near our resorts scenic veranda area is a resort computer for your use that is FREE OF CHARGE plus there is also FREE WIRELESS INTERNET ACCESS.
The airport you would be flying into is the Alexander Hamilton Air, US St Croix. Our resorts website states as of January 21, 2008 the cab ride for 2 passengers is only $25 each way from the airport to the resort and from the resort back to the airport using the resorts voucher system.
IMPORTANT PLEASE NOTE, in order to try to be fair to all interested potential interested renters the first prospective tenant to send the landlord payment in full will secure the unit for their use. Other later arriving payments will be returned. The EARLIEST POSTMARK gets our unit if two checks arrive for the same confirmed reservation unit- check in date.
Check the resorts website at http://www.hotelonthecay.com and compare their higher prices and please note the resorts extra added costs per night person if more than 2 people are using these sleep 4 units plus the energy tax and sales tax that are already accounted for in our lower total prices.
Another option for us depending on unit availability is to reserve any Prime vacation week 1 through week 10 in 2010 (excluding only week 7) in place of our weeks 10 or 11 in 2008 for a renter in accordance with the terms stated in Item number 5B of this rental agreement after a good faith down payment being made.
Our resort is located on a beautiful private island in the St. Croix, Virgin Islands. It is only a two-minute complimentary ferry ride to Christiansted, St. Croix.

1 Please NOTE, our policy requires the renter of the rental party must be able to prove that they are at least 25 years old upon check in to permit use of the unit by the renter. A credit card imprint will be required upon check in to cover any possible damages to the unit or resort.
The person who’s name that is to be put on the rental lease must be willing to send proof of their age being 25 years or older by the use of some type of official picture ID in order to rent from us. The person who’s name is on the rental lease must be present in order for their group to be allowed to be checked in without advance emailed permission from us the landlord to the resort. Thank you in advance for your cooperation if requested in meeting requirement on verifying age requirements.

3. Our Unit being offered for rent is condo unit number(unit number to be assigned upon check in) week number 4 at the Hotel On The Cay.
Please note if you want a fancy snobby type resort, then IMHO this resort may NOT be the resort to enjoy your vacation at.
Please note that IMHO that our units are NOT 5 Star or Gold Crown units. IMHO they are smaller plain older units in a great resort setting a beach. If you like a relaxing quiet resort that is within one minute of the town activities then you may enjoy the resort and its setting and Island location like we and the other owners do.
4. Length of rental week number 4 year of 2010 is for 7 nights. Your rental begins on check-in at 4:00 PM Saturday March 13, 2010 and check-out is on or before Saturday March 20, 2010 at 12:00 noon. If you do not plan to check in on your assigned check in date, but plan to check in on a later date we suggest that you contact the resort and advise them of that fact one or two days before your reservation check in date as stated on your confirmed reservation.
By calling them a head of time they will know that you still plan to use it and not mistakenly assign your unit to someone else.
There is a no refund policy once the timeshare is rented. You you are throw out of the resort for misbehavior their will be no refund on the rental and you may also lose your security deposit. The only type of refund that would be allowed is if the this unit is if it is uninhabitable as stated in part numbered section 7 of this rental lease agreement, and no other similar units are available for the same week at this resort. The parties have signed their names below to evidence their agreement to the terms and conditions of this rental lease.
5A. The rent for the unit as listed for the dates listed above is only $899 (in US Dollars) PLEASE NOTE, NO PERSONAL CHECKS WILL BE ACCEPTED if with in 30 days of the check date, DO NOT SEND CASH. Also required is a additional $100. refundable security deposit per unit that is to be paid at the same time as the rental deposit is paid. The refundable $100 security deposit refund is to be sent by snail mail or email to the renter with in 5 business days or less after the above check out date has passed if no damage fees or any other unpaid fees are owed by the renters to the resort. Please make payable to Bruce F. Czajkowski in US Dollars the amount of $999.
If it is with in 30 days or less of the reservation check in date that you want, please only pay by either Paypal or send a UNITED STATES POSTAL OFFICE MONEY ORDER By US Priority mail. Please email us the postal tracking number and a copy of that money order asap by email or fax to confirm to us that your payment is on the way to secure your reservation. We will in most cases hold that reservation for 7 days from date you send that email or fax. Or you can use PAYPAL to make your rental payment.
If you are snail mailing a payment we strongly advise because of the BAD and CARELESS DELIVERLY SERVICE AND THE LACK Of SECURITY provided by both UPS and DHL on their deliveries in our area, we strongly advise that you do not waste your money using either of them. We have found some of their deliveries in the snow, etc and not were supposed to be. You can SAVE a fair amount of MONEY by instead safely assure that your mailing will not get lost by using US Priority mail to send your mailing to our PO Box # 661.
Our unsecured rural mail box sits out of our view about one block from our home so that is another reason we suggest using our PO box # 661 if you are sending payment by Mail. We will call you asap when we receive payment. Please include your home phone number in your mailing. Thank you for your cooperation.
Payment required to secure unit is 100% of rental price as show above for this confirmed reservation.

5B. In most cases for special request for a non existing reservation check in date that we do not have a confirmed reservation for, there is NO CHARGE to have us check for availability for your special request that we do not have reserved at that time.
But a $200 good faith Pay Pal Good Faith down payment is required before we will CANCEL one of OUR confirmed reservations and try for a period of 2 business days after the Pay Pal good faith down payment is received to reserve your special request time period.
The main reason for this policy is that we may have already reserved a hard to reserve high demand reservation and may have to cancel that high demand reservation to try and accommodate your request.
The reason we have the rule as it is not fair to the owners to have the owners cancel a high demand and book a special request week, so their efforts and time is not wasted by people who made that special request and then not rent.
Once the confirmed reservation is made the renter-tenet after being emailed is to send in the remaining balance due with in 24 hours.
5C To help you avoid rental scammers ask them for proof of a confirmed reservation for the proposed rental. They should definitely be willing to provide documented proof that they either own that fixed numbered week by providing a copy of a warranty deed or provide a confirmed reservation in their names from that resort or resorts management company if they own a so called floating week ownership at that resort.
You should also be aware that if it is a week that has been obtained from a exchange company like II or RCI that is against those exchange companies rules for non owners to rent out that exchange week to others.
If any non owner has broken an exchanges companies rules and rented out an exchange company week to you, you might NOT BE ALLOWED to checked into the resort and NOT BE ALLOWED to use that week even if they have put a so called 'guest certificate in your name'.
The above due diligence should be done to help you avoid scammers so your vacation plans are not ruined and your vacation money does not go down the drain because you were lied to.
The time and money that you could lose includes the time you spent getting to the resort, the travel costs to travel to the resort which could include airfare.
Also you may have the extra hassle and loss of your valuable limited vacation time in trying to find some other hopefully available suitable accommodations especially high demand vacation times, and the extra money to now having to be spent for those alternative accommodations at overly expensive full rack resort rates.
6. The tenant agrees to rent the Unit from the landlord, and the landlord agrees to lease the Unit to the tenant.
7. The term of the lease is only for the exact period designated in paragraph 4. The tenant may use the Unit during the term without interference subject to the terms of this lease. If the Unit is not habitable on the day that the term starts by reason of flood, fire, storm, or for any other reason, the landlord shall refund the rent forth with and will there after have no further liability to tenant.
Here are some links to renter's Travel Insurance that could help lessen any financial loss because of unforeseen circumstances of storms and other weather problems, travel problems like airline strikes or Airline Bankruptcies, health , etc problems or any other problems causing financial loss the landlord did not cause and is not responsible for.
You may also want to contact local travel agents and check out the cost of the of a level of a Travel Insurance package that you feel comfortable to protect your self against unforeseen circumstances that may affect or end your vacation plans.

8. The tenant agrees to pay the rent as set forth in paragraph 5 at the times stated in that paragraph. If the rent is not received by landlord on or before the date specified, the landlord may declare the tenant in default by written notice sent by either certified mail, e-mail, or fax. If the default is not cured within 3 days after receipt of the notice, the landlord may rent the Unit to others.
9. The tenant may use the Unit only in accordance with the rules and regulations of the resort in which the Unit is located. No pets are allowed. If the tenant's or their guests violate the resort rules which results in resort kicking them out, there will be no refund of any portion of the rent for the unused time.
10. The landlord will pay maintenance fees and all utility charges for the Unit.
11. The tenant will pay for all the telephone calls made from the Unit, any housekeeping services for which there is an additional charge, and any extra charges (except utilities) imposed by the resort for services or for the use of its facilities.
12. The tenant agrees to maintain the Unit in the same condition as it is at the start of the lease term, except for ordinary wear and tear. The tenant will pay for all repairs, replacements, and damages caused by the act of neglect of the tenant, the tenant’s household members, or guests
13. Immediately upon receipt of the full rental payment, the landlord will notify the resort manager in writing that the tenant will be occupying the Unit during the stated term. At this time, a copy of the letter will be sent by landlord to tenant.
14. The landlord is not responsible for any inconveniences or interruption of services due to repairs, improvements, or for any other reasons beyond the landlord’s control.
15. The tenant may not sublease the unit or assign this lease without the landlord’s prior written consent.
16. All notices may be sent to the address, e-mail, or fax numbers set forth in the opening paragraphs of this lease.
17. Additional charges for services and activities may be charged additional fees by the resort to the tenant.
