Man Fights Marriott Crystal Shores for Beach Access

Recently an article was published on the website MarcoNews.com by Quentin Roux entitled “Disgruntled timeshare owner seeks out” which brought to light some issues regarding timeshare resorts and the access they allow their owners to have throughout the year to the resort amenities. About a year ago a man named Gary Vinson decided to purchase a unit at Marriott Crystal Shores resort in Marco Island, Florida, as part of the negotiations Gary wanted the resort to allow him and his family to have access to the resort’s beach area throughout the year, even if they were not currently staying at the resort. To ensure access was granted Gary received three different letters of authorization stating him and his family would be allowed to use the beach at anytime. On several occasions members of Gary’s family were told they would not be able to use the beach and the letters were fraudulent. Gary decided to take his complaints further up the chain of command and complained to Marriott Vacation Club corporate offices, which decided Gary was right on this matter and his family should have access to the beach whenever they like. With this issue resolved Gary has started to raise another issue, due to the “rude and unprofessional” treatment he claimed to receive he is trying to null and void the entire contract for the sale of the timeshare.

From prior experience I believe it is highly unlikely this contract will get cancelled for customer service not living up to the expectations of the timeshare owner. Anyone who has sat through a timeshare presentation has most likely encountered some sort of behavior considered to be unprofessional, whether it be hard sell tactics or the sales person flat out lying about the terms of the sale. If anyone has tried to rescind the timeshare after purchasing they have found you must follow every single item exactly as it states in the contract within the given time frame. Marriott is most likely embarrassed by the treatment received by this individual from its customer service team, however if contracts in the timeshare industry were allowed to be cancelled because of “rude and unprofessional” behavior there would be no timeshare resorts left. The real shame here is this person did not take the time to research the options available for timeshare purchases out there, if he had he would have found timeshare resales are available at the same resort for a fraction of the price.

We really hope this situation is resolved in such a manor that Gary and his family will be pleased with the outcome, however from past experiences many owners know the contract is unlikely to be voided.
